According to TMZHolmes and Robach, who reportedly embarked on an extramarital affair last March after their marriages fell apart, are “confused and frustrated why the ABC News brass at first told people internally there would be no disciplinary action, and then the company did an about- face.”

“Amy and TJ are out, a decision has been made,” an insider told Us Weekly of the newscasters. “The network is negotiating with them on their exit deals and an announcement.”

In response, Holmes has retained celebrity lawyer Eric George, while Fox News has confirmed that Robach has hired attorney Andrew Brettler, who has represented Armie Hammer, Chris Noth, Bryan Singer, Danny Masterson and Prince Andrew.

Both parties were taken off the air on Dec. 5.

Sources tell TMZ that if ABC continues to keep the new couple off the air or drops them altogether, the pair are prepared to sue, with racial bias (Robach is White, while Holmes is Black) possibly coming into play.

If the broadcaster argues that the affair contravenes its morals clause, Robach and Holmes’ lawyers are prepared to pose the question: “Has ABC ever used the morals or conduct clause to fire or discipline two consenting adults at equal levels when both were White?”

Former Bachelor host Chris Harrison shared his thoughts on the ongoing scandal during an episode of The Most Dramatic Podcast Ever.

“I have a lot of strong opinions about this. This is personal,” the ousted TV personality said, per Us Weekly. “A report came out that Amy and TJ had been let go and that they have lawyered up. And to that I said, ‘Good for you guys. Good for you.’”

Last week, PEOPLE reported that it is “unlikely” that the pair will return to the air as co-hosts on GMA3: What You Need To Know.

“There are no negotiations about their future. ABC is completing their investigation,” a source said.

“While it is unlikely they will return in the capacity they were in — the longer time goes on, it becomes less likely they will return — there are still open lines of communication and further discussions are being had about what will happen.”

The TV personalities sparked dating rumors in November after the Daily Mail published photos of the colleagues cozying up to one another in New York City. Both Robach, 49, and Holmes, 45, were still married at the time, although they were each separated when the affair became public.

They were quickly benched by ABC bosses from their daytime gig with no timeline given on when — or if — they’ll return to air.

Both Robach and Holmes quickly found themselves fodder for jokesters on social media after their dalliance was revealed. But the fallout has only brought them closer.

“Amy has no regrets,” an insider told Us Weekly last week. “She wants to keep her job, but even if she loses it, she’s in love.”

“Amy and TJ are sticking together and putting on a united front,” another source told Us Weekly. “They really only have each other right now.”

Neither Robach nor Holmes have publicly commented on their relationship, but the pair jetted off to Florida over the holidays where they put on numerous displays of PDA as they were spotted “making out like teenagers.”

After Robach reportedly left her hubby, Melrose Place star Andrew Shue, last summer, Holmes filed for divorce from his spouse, Marilee Fiebig, in December.

Sources maintain that the two only started dating after separating from their partners.

“This was two consenting adults who were each separated. They both broke up with their spouses in August within weeks of each other. The relationship didn’t start until after that,” a confidante spilled PEOPLE.

Now, free from hiding their feelings, the duo want to let the world know they “are in love.”

“They spent the holidays together and are spending all of their time together right now,” an insider told PEOPLE after the couple vacationed down south. “They are fully in a relationship. They are not hiding anything at all because they have no reason to.”
